# Game Settings


# Game Customization: Easy Mode

After creating a campaign, you will see the selected game template in the "**Game Settings**" To access the game editor, click the "**Customize Game**" button on the right.

The game editor offers two modes:

* **Easy Mode**: Effortlessly modify your game by replacing images supported by the game.
* [**Pro Mode**](/game-settings/game-customization-pro-mode): Slightly more challenging to use but provides sophisticated editing with advanced tools.

Switch between modes quickly by selecting the "**Easy Mode**" or "**Pro Mode**" button in the top right corner of the Game Editor.

## Interface

1. **Categories:**\
   Images with similar characteristics are grouped together in the same area. Depending on the game, there may be more or fewer groups of areas available.
2. **Settings:**\
   When you select a group within a category, the corresponding image appears on the settings screen. Here, you can select the image and replace it with your own.
3. **Preview:**\
   Displays the game with all applied changes.
4. **Top Right Button:**\
   Provides the following functions:
   * Restore Default Settings: Resets all images in the game to their original state.
   * Save and Exit: Saves all changes and exits the Game Editor.
   * Pro Mode: Switches the Game Editor to Pro Mode.

   * Download: Saves all game images in a ZIP file.
   * Upload: Adds all game images from a ZIP file.

## Customizing your game:

**Step 1**: Select images Choose a group of images in the Categories area to import them to the Settings screen. Upon selecting an imported image on the Settings screen, you will see control buttons:

* Download: Saves the current image file.
* Upload: Replaces the current file with an image file from your PC.
* Restore image: Resets the image to the original.

**Step 2**: Modify the image (upload) Modify the image imported to the settings screen with a graphic image of your own creation:

1. Select the 'Upload' button.
2. Drag the modified graphic image from your PC or click "Select Image" to choose a file.
3. Drop or select an image to upload and replace it with your created image.

**Step 3**: Preview your changes After the modified image finishes uploading, the game automatically updates in the "Preview" section on the right. Preview how the changed game will look.

Repeat Steps 1 through 3 to modify all images in your game as desired.

**Step 4**: Save your changes Once you have finished changing all images, select the "Save and Exit" button in the top right corner to save your changes and exit the game editor.

# Game Customization: Pro Mode

## Interface

### 1. Screen

The screen area displays all the screens (scenes) of the game.

Typically, there are four main screens in a game:

* **Loading**: This reads the files needed for game configuration.
* **Instructions**: This shows the point when the game load is complete and ready to play. This screen also provides a simple guide on how to play the game.
* **Play**: This is the screen where users play the game.
* **Results**: This shows the results of the game after the user finishes playing.

### 2. Components

When you select a screen area, all images belonging to that screen are loaded. These images are then displayed in components.

Images are grouped into several types according to their characteristics.

### 3. Canvas

The canvas shows a visual representation of the selected screen (scene).

By selecting an image displayed on the canvas, you can modify its sprite attributes.

When a user selects an image on the canvas, they can directly adjust the size and position of the image by dragging its edges.

### 4. Sprite Attributes

Sprite attributes show the sprite properties applied to the image selected in the component or on the canvas.

You can precisely control the position and size of the image by changing the values in these attributes.

### 5. Canvas Control Buttons

* **Undo**: Reverts the most recent changes.
* **Redo**: Reapplies the most recent changes.
* **Fullscreen**: Displays the game editor in full screen (may not work on some devices).
* **Preview**: Displays a pop-up window showing the game with all changes applied. You can check how the game has been modified and play it.

### 6. Top Buttons

* **Restore Defaults**: Resets all images of the game. All modified images will be deleted.
* **Save and Exit**: Saves all changes and closes the game editor.
* **Easy Mode**: Switches the game editor to Easy Mode.
* **Properties**: Modifies the sprite attribute information.

## Game Customization

### Step 1, Select Image

When you select Loading, Instructions, Play, and Results from the screen area, related images will appear in the left component area. Then, you simply select the image you want.

You can also directly select an image on the canvas with your mouse. The selected image will be automatically selected in the left component area.

After selection:

1\. The control buttons for the selected image will be displayed in the component area.

* Download Button: Downloads the current image file.
* Upload Button: Uploads an image file from your PC to replace the current file.
* Restore Button: Resets the image.

2\. The selected image on the canvas is highlighted with a red rectangle.

3\. The attributes of the selected image will be displayed in the Sprite Attributes.

### Step 2, Replace Image

To change the selected image, follow the steps below to upload and modify your image.

* Select the 'Upload' button.
* Drag the modified graphic image from your PC or click "Select Image" to choose a file.
* Once you drop or select the image, the upload process will begin and it will be replaced with the image you've created.

**Changing the Position or Size of the Image**

**Using the Canvas:**

You can change the size and position of an image by selecting it on the canvas.

* **Size Change**: Grab the corner of the image and drag to adjust the size.
* **Position Change**: Press and drag the middle part of the image to move it.

**Using Properties:**

For advanced users, you can precisely control the position and size of an image by changing the values in the Properties.

### Step 3, Check Modified Content

After modifying the images of the game, you can preview how the changed game will look by selecting the "Game Preview" button in the top area.

### Step 4, Save and Exit

Once all image modifications are complete, select the "**Save and Exit**" button in the top right to save all changes to the game and exit the game editor.

# Other Features

## Download All Images of the Game

If you do not want to download and customize images one by one, you can select the 'Download' button at the bottom of the game editor to download all images of the game as a single ZIP file.

## Upload All Images of the Game

You can select the 'Upload' button at the bottom of the game editor to upload all customized images for the game (as a single ZIP file) at once.

The modified image must have the same "file name" and "image dimensions (Width x Height)" as the original image.

You can also choose to modify some images, add them to a ZIP file, and upload it.

For example,

* Game A uses a total of 40 images.
* The user downloads all images and modifies 5 of them.
* When the user uploads a zip file, it's not necessary to include all 40 images in the zip file, it can contain just the 5 modified images.

## Resetting Images

After modifying the game images, you can reset them using the following method:

* Select the image.
* Select the 'Restore' button.

## Reset All Images

After modifying the game, you can select the "Restore Defaults" button in the top right corner of the game editor to reset all images.

# How to Modify Graphics

First, you need to download the image you want to modify as follows:

1\. Select "**Customize Game**" in game settings, and you will be redirected to the game editor.<br>

2\. Select an image and click '**Download**' to download the corresponding image.

3\. Alternatively, you can select the '**Download**' button (bottom right of the whole screen) to download all images of the game as a ZIP file at once.

After downloading all image files, you can open and edit the files in a graphic editor tool.

1\. Open the image file in the graphic editor tool.

Once the image editing is complete, you can upload and apply the modified image file to the game.

1\. Select the image and click 'Upload' to upload the modified image that will replace the current image.

2\. Then, the modified image is uploaded and applied to the game.

# Activating the prepared game

Starting from August 15, 2024, the newly updated Studio allows users to activate games at any time, regardless of paid subscription status. Each account can use up to 50 CPP (Cost Per Click) without any time restrictions.

Activated games can be instantly launched via the URL link in both PC and mobile browsers. In the mobile app, the URL can be loaded through Webview.

Each account is supported with up to 50 CPP without time restrictions, and if additional CPP is needed, [you can purchase it for a fee](/paid-plan-and-publish/subscribing-to-a-paid-plan).


# UserID & Webhook

### 1. Introduction

The studio provides branded mini-games (HTML5 games) and stores game results (scores, playtime) in the system database.

However, some brands want to retrieve game results and store them in the brand's database.

This guide explains how brands can obtain game results from the studio.

### 2. Overview

#### Basic scenario

1. The game player is connected to the customer (brand)'s system (website or app, etc.).
2. The brand's system recognizes the player and assigns a unique ID ('userid') to the player.
3. The brand's system loads the branded mini-game by calling the system's URL with the 'userid'.
4. The player plays the branded mini-game.
5. When the player completes the play, our (studio) system sends the game results to the brand's system using the Webhook URL.

#### Setup process

1. The customer needs to create a campaign on our system's Studio website.
2. The brand needs to create a program (webhook) on their server to obtain game results.
3. The brand needs to update the webhook URL in the "Return Game Result" section of the campaign settings.

### 3. Implementation

#### Load branded mini-game with userid

* In the basic scenario step 3, the brand's system needs to call our (studio) system's URL with the 'userid'.
* The 'userid' value must be passed using the GET method.

#### Parameters

* This webhook must have a URL that can be accessed from the system server.
* Our (studio) system sends game results using the POST method with the following parameters.

# UserID

## User ID Setup Guide

### Overview

When using the **UserID & Webhook** campaign type, your system must send a unique `userid` value to identify each game player. This userid is included in the webhook data sent back to your server after each game play.

1. Your website generates or retrieves a `userid` for the current user
2. Your website passes the `userid` to the game via URL parameter
3. The user plays the game
4. Our system sends the game result (including the `userid`) to your Webhook URL

If your website does not have a user system, you can generate a unique ID and store it in the browser.

**Advantages:**

* No sign-up system needed
* Quick to implement
* Returning users keep the same ID

**Limitations:**

* If the user clears browser data or uses incognito mode, a new ID is generated
* Cannot track the same user across different devices or browsers
* Not suitable when accurate user identification is required

After each game play, the following data is sent to your Webhook URL via POST:

When using the **UserID & Webhook** campaign type, game results are not displayed on an in-game leaderboard. Instead, the results are sent directly to your server via a webhook POST request.

This allows you to collect game data in real time and integrate it with your own system — whether that's a database, CRM, analytics platform, or even a simple Google Sheet.

If you don't have a backend server, you can use **Google Apps Script** to receive webhook data directly into a Google Sheet. This is ideal for promotions, contests, or quick setups.

#### Step 1: Create a Google Sheet

1. Go to [Google Sheets](https://sheets.google.com) and create a new spreadsheet
2. In the first row, add headers:

3. Set **Result data format** to **json**
4. Click **Update the URL information**

#### Important Notes

* **Result data format must be set to `json`** — Google Apps Script's `JSON.parse(e.postData.contents)` expects JSON format. If set to `default`, the data will not be parsed correctly.
* **Re-deploy after code changes** — Every time you edit the Apps Script code, you must create a **New deployment** (not just save). The URL changes with each new deployment, so update the Webhook URL in Studio accordingly.
* **Google account permissions** — The script runs under your Google account. The first deployment requires authorization to access your Google Sheets.
* **Rate limits** — Google Apps Script has a daily quota (approximately 20,000 requests/day for free accounts). For high-traffic campaigns, consider a dedicated server instead.
* **Response time** — Apps Script may have a slight delay (1-3 seconds). This does not affect the game experience, as the webhook is sent asynchronously after the game ends.
* **Data privacy** — Game result data is stored in your Google Sheet. Ensure your spreadsheet sharing settings are appropriate for your data privacy requirements.

Only paid plan users can purchase additional CPP.

If there is any CPP left over, <mark style="color:red;">**it will automatically expire**</mark> on the same day the paid plan ends.

Additional CPP does not offer a subscription. It is a one-time payment for the month when the Paid Plan is active, and multiple payments are allowed. However, refunds are not possible after payment.

Local VAT will be added if payment is made in Switzerland.

BY USING ANY OF THE SERVICES PROVIDED ON THE SERVICES, YOU SIGNIFY YOUR ASSENT TO BOTH THESE TERMS AND CONDITIONS (the "Terms of Use" or "Agreement") AND "DATA PROCESSING AGREEMENT" or "DPA" as set out in the Appendix A. This DAP applies only if you use BMG for your marketing or advertising campaign ("BMG campaign") for the individuals in the EU countries.

If you do not agree to any of these terms, then please do not use the Services.

The Terms of Use constitute a binding legal agreement between You as user ("you") and the Company. BMG Websites collaborates with their Sub-Processors, in order to facilitate the delivery of services to its Users and to collect payments such as Stripe, Microsoft Azure (Sweden) or any other 3rd party processors.

This Terms of Use sets forth the legally binding terms for your use of the Services and they shall apply to all users of the BMG Website, including users uploading content and/or other materials on or through the Website in order to create the BMG and to publish the BMG campaign. By using and creating an account from the BMG Website, you agree to be bound by this Agreement.

The BMG Website may modify this Agreement from time to time and such modification shall be effective upon posting by BrandedMiniGames.com on the Website. You agree to be bound to any changes to this Agreement when you use the Services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.

#### 2. Eligibility

Use of any Membership in the Services is void where prohibited. By using the BMG Website, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older; and (d) your use of the Services does not violate any applicable law or regulation. Your profile may be deleted and your Membership may be terminated without warning, if we believe that you are less than 18 years of age.

Minors are not allowed to purchase Premium/Upgraded Services. Accordingly, by purchasing such services the user declares and represents that he/she is more than 18 years of age and that he/she has full legal capacity to complete such contractual action without need for any additional approvals or consents.

You warrant that you are legally authorised to create and publish the BMG campaign to act on behalf of the brand if you upload any brand logo or product images of the brand on using BMG Services.

The Services are intended solely for business customers (B2B). By using the Services, you represent and warrant that you are acting in the course of your trade, business, or profession and not as a consumer.

#### 3. Provided Services

Subject to full compliance with the Terms of this Use, Branded Mini-Games shall provide certain services, as described more fully on the Website ("Services"). Services may include, but not be limited to, the software for customisation of games for your marketing or advertising, designing, marketing campaign automation platform and templates related to the games, sharing and linking of media and/or document files, and hosting your BMG campaign including your User Content (including, but not limited to text, information, data, graphics, photographs, images, illustrations, animations, software, audio and video, also collectively known as the "Content") on Microsoft Azure server located in Sweden, analytics of your BMG campaign and integrating your BMG campaign to other 3rd party services and so on. Please note that part of the Services (or special features) may be provided only to Users who subscribe for such Services and BMG Website may charge fees for such Services either prepaid one off payment or monthly subscription payment subject to your confirmation of purchase. BMG Website may change, suspend or discontinue any or all of the Services or any Content for any reason, at any time, including the availability of any feature or part of the Content at its sole discretion. BMG Website may also impose limits on all or any of the Services or restrict your access to parts or all of the Services without notice or liability. BMG Website may charge fees for the use of the Services or part of them and may include advertisements or other commercial content in any BMG Website including such which have been created by users unless stated otherwise.

We do not guarantee that the iFrame game will run properly on the iOS browser because of known issues on this platform. Branded Mini-Games team will take reasonable endeavours to protect your customised BMG Website. However, we do not guarantee that it is 100% safe against hacking / cheating. We take no responsibility for malicious hacking scores.

The Premium/Upgraded Services provided by BMG Website (as defined on the Website) are provided according to the provisions of this Agreement and the specific commercial provisions and policies as detailed on the Website, and such provisions and policies as may be amended or changed from time to time, are incorporated herein by reference and shall be considered as an integral part hereof.

#### 4. General Undertakings

You accept sole responsibility for all of your activities using the Website, including your conduct on the site and any and all content you may submit, post or share via the Website. You will not use the BMG Website and its Services for any unauthorized or illegal purpose. You will be responsible for ensuring that you do not violate any laws of your jurisdiction, including but not limited to copyright laws. You will not upload or transmit viruses, worms or any other destructive code.

You will be responsible for ensuring you comply with all applicable laws in your jurisdiction for the Terms and Conditions/Privacy Policy used for your campaign for your target users. You will take full legal responsibility to update the campaign settings and and legal texts including campaign terms and privacy policy to fully comply with your jurisdiction where the campaign takes place. Especially If your business is based in the European Union (EU), or you process the personal data of individuals in the EU, you are responsible to comply with the General Data Protection Regulation (GDPR). Branded Mini-Games offers tools as a resource, but we don't offer legal advice. We recommend you contact your legal counsel to find out how the GDPR affects you.

#### 5. The BMG Website

The BMG Website may contain third party content and links to third party websites that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party content or websites or any of their contents. In addition, BMG Website will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve BMG Website from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the BMG Website and to read the terms and conditions, and privacy policy of each other website that you visit.

#### 6. Prohibited User Content/Actions

Please don't use BMG Website to publish anything offensive, to promote anything illegal, or to harass anyone. You may not create

* Any contents offering to sell illegal goods or services
* Pornography/sexually explicit content

Also, you shall not:

* Use any misleading or incorrect names, unlicensed contents upon using our Services.
* Share your password.
* Decipher, decompile, disassemble, or reverse engineer any of the software on our Website, or in any way used or downloaded from the Website.
* Use any of the software on our Website, or downloaded from the Website, to create a competing product.

You represent and warrant that you either own or have permission to use all of the material, content and data, you submit to BMG Website in the course of using the Service ("Content"). You retain ownership of the Content that you upload to the Service. We may use your Content (including any personal information therein) only as described in these Terms, our Privacy Policy and, if applicable, our Data Processing Addendum. Games created by customers paying for them are preserved for one year after the campaign ends.

#### 9. Website Access

BMG Website hereby grants you permission to use the Website as set forth in these Terms of Use, provided that: (i) you will not alter or modify any part of the Website other than as may be reasonably necessary to use the Website for its intended purpose and/or in a manner allowed by the Company; and (ii) you will otherwise comply with the terms and conditions of these Terms of Use.

In order to access some features of the Website, you will have to create an account. You may never use someone else's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You accept sole responsibility for keeping your password secure. You must notify the Company immediately of any breach of security or unauthorized use of your account. Although Branded Mini-Games will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of BMG Website or others due to such unauthorized use.

#### 10. Online Sharing through Third Party Services

BMG Website enables you to share your BMG campaign and/or User Content (as defined below) through third party websites, blogs or ad network systems. When sharing your BMG campaign through third party services you shall continue to comply with all provisions of this Agreement. You are also required to comply with the terms of any of the services through which you are sharing your creation.

#### 11. Third Party Services

You are fully aware of the fact that BMG Website shall not have any responsibility or liability with regard to any third party services used by you on or through your BMG Website formed web content, such as payment services, and any use of such third party services shall be at your own responsibility and liability.

#### 12. Fees and Payment

Some of the Services offered on the Website require payment of fees ("Charged Services"). If you elect to sign up for Charged Services, you shall pay all applicable fees, as described on the Website in connection with such Charged Services selected by you. BMG Website reserves the right to change its prices at any time. You authorize BMG Website directly or through third parties, to make any inquiries it considers necessary to validate your account and financial information that you provided while signing up for such Services.

**By opting for bank payment, the Services will be activated promptly. Please note that for bank deposits, we require a waiting period of 8 days, excluding weekends. If weekends fall within this period, the waiting time extends to a total of 10 days. It is important to understand that if the final payment is not made within the 10-day timeframe, the Services will be canceled, and an internal Yellow card will be issued. Subsequently, the account will be blocked for a duration of 30 days starting from the cancellation date. Following the 30-day block, it will be possible to resume paid payments. However, repeated non-payment occurrences will result in the permanent deactivation of the account with a Red card. In the event that a Yellow card has been issued and the payment is received after the 30-day blocking period, the Charged Services will be promptly reinstated. It is crucial to note that the blocked days during the waiting period will not be reimbursed.**

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. You agree to pay any such taxes that might be applicable to your use of the Services and payments made by you to BMG Website.

All fees related to using Charged Services are charged automatically using the payment method as determined in the Website. If BMG Website does not receive a request by the user, through the managed premium section under BMG Website, for Charged Services termination you acknowledge and understand that BMG Website will continue to charge you for the Charged Services as long as your account remains active regardless if the Charged Services are used or not.

Users purchasing Charged Services shall pay any and all prices and fees due for such Services. As the Services are provided on a B2B basis, all prices and fees are non-refundable unless otherwise expressly noted, even if such Charged Services are suspended, terminated, or transferred prior to the end of the Services term. BMG Website expressly reserves the right to change or modify its prices and fees at any time, and such changes or modifications shall be posted online at the Website and effective immediately without need for further notice to any user. Any changes or modifications in prices and fees shall be effective when the Services in question come up for renewal as further described below.

IN ORDER TO ENSURE THAT YOU DO NOT EXPERIENCE AN INTERRUPTION OR LOSS OF SERVICES, MOST SERVICES OFFER AN AUTOMATIC RENEWAL OPTION. THE AUTOMATIC RENEWAL OPTION AUTOMATICALLY RENEWS THE APPLICABLE SERVICE FOR A RENEWAL PERIOD EQUAL IN TIME TO THE ORIGINAL SERVICE PERIOD. FOR EXAMPLE, IF YOUR ORIGINAL SERVICE PERIOD IS FOR ONE YEAR, YOUR RENEWAL PERIOD WILL BE FOR ONE YEAR. WHILE THE DETAILS OF THE AUTOMATIC RENEWAL OPTION VARY FROM SERVICE TO SERVICE, THE SERVICES THAT OFFER AN AUTOMATIC RENEWAL OPTION TREAT IT AS THE DEFAULT SETTING. THEREFORE, UNLESS YOU CANCEL YOUR SUBSCRIPTION, THE BMG WEBSITE WILL AUTOMATICALLY RENEW THE APPLICABLE SERVICE WHEN IT COMES UP FOR RENEWAL, AND WILL TAKE PAYMENT FROM THE PAYMENT METHOD YOU HAVE ON FILE WITH THE BMG WEBSITE THEN CURRENT RATES, WHICH YOU ACKNOWLEDGE AND AGREE MAY BE HIGHER OR LOWER THAN THE RATES FOR THE ORIGINAL SERVICE PERIOD. YOU MAY CANCEL YOUR SUBSCRIPTION FROM SUCH SERVICES PRIOR TO THE AUTOMATIC RENEWAL AT ANY TIME. IN SUCH EVENT THE SERVICES SHALL BE DISCONTINUED UPON THE EXPIRATION OF THE RESPECTIVE PERIOD YOU HAVE PAID FOR AND YOU SHALL NOT HAVE ANY CLAIMS TOWARDS BMG WEBSITE IN RELATION TO THE DISCONTINUATION OF THE SERVICES.

#### 13. Cancellation

The BMG Website's Charged Services are provided on a prepay basis or on subscription basis as per your selection on the pricing plan of the Website. BMG Website users may decide to discontinue their use of any Charged Services at any time. Such cancellation is done by the users themselves on the BMG Website and according to the instructions and cancellation policy posted therein per each pricing plan.

YOU ACKNOWLEDGE THAT CERTAIN SERVICES PURCHASED ON OR THROUGH THE WEBSITE MAY BE NON-REFUNDABLE. THE TERMS OF EACH PURCHASED SERVICE OR APPLICATION ARE INDICATED IN THE WEBSITE AND/OR AS PART OF OR DURING THE PROCESS OF PURCHASING SUCH SERVICES OR APPLICATION. IT IS YOUR OBLIGATION TO VERIFY YOUR ABILITY TO CANCEL A SERVICE PRIOR TO PURCHASING ANY CHARGED SERVICE. BRANDED MINI-GAMES WILL NOT REFUND ANY AMOUNTS PAID FOR NON-REFUNDABLE CHARGED SERVICES.

#### 14. Intellectual Property Rights

The Content on the BMG Website (as defined above), except for all User Content (as defined below), is subject to copyright and other intellectual property rights under local and international laws conventions. To the best of its knowledge, BMG Website uses only Content which is allowed and permitted for use by the owner/s of the copyrights and other intellectual property rights therein. Content on the Website is provided to you AS IS only and it may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners (if such consent is required). The BMG Website reserves all rights not expressly granted in and to the Website and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Content of third parties obtained through the Website for any commercial purposes. You agree not to circumvent, disable or otherwise interfere with security related features of the Branded Mini-Games Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the BMG Website or any of the Content therein.

#### 15. Reference

You do acknowledge and agree to the Company, Branded Mini-Games being able to reference you or the brand you used for BMG campaign as a client without separate agreement. You also agree that your BMG campaign can be used by Company in marketing and public relations activities only for reference purposes.

#### 16. Security

You are responsible for maintaining the security of your account and content, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the website. You agree to immediately notify the Company in writing of any unauthorized uses of your account or any other breaches of security. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You acknowledge and agree that under no circumstances will the Company be liable, in any way, for any acts or omissions by any BMG Website User or other third party, including any damages of any kind incurred as a result of such acts or omissions.

#### 17. Warranty Disclaimer & Limitation of Liability

A. YOU AGREE THAT YOUR USE OF THE BMG WEBSITE SHALL BE AT YOUR SOLE RISK. Under no circumstances shall BMG Website be held liable for any delay or failure in this Website and/or any of the Services and/or information on the Website directly or indirectly resulting from, arising out of, relating to or in connection with events beyond the reasonable control of BMG Website, including, without limitation, internet failures, equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, earthquakes, explosions, acts of God, war, terrorism, intergalactic struggles, governmental actions, orders of courts, agencies or tribunals or non-performance of third parties. These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by the Company without restriction or limitations.

You agree that: (i) the BMG Website shall be deemed solely based in Switzerland; and (ii) the BMG Website shall be deemed a passive website that does not give rise to personal jurisdiction over BMG Website, either specific or general, in jurisdictions other than Switzerland. These Terms of Service shall be governed by the internal substantive laws of Switzerland, without respect to its conflict of laws principles. Any claim or dispute between you and the Company that arises in whole or in part from the BMG Website shall be decided exclusively by a court of competent jurisdiction located in Switzerland. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and BMG Website's failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.     5. a third party to respond to requests relating to a criminal investigation or alleged or suspected illegal activity;
    6. a third party, in order to enforce or defend our rights, or to address financial or reputational risks;
    7. a rights holder in relation to an allegation of intellectual property infringement or any other infringement; and
    8. other recipients where we are authorised or required by law to do so.

**Where we transfer and/or store your personal information**

11. Our company is based in Switzerland. Your personal information is stored and processed on secure servers located exclusively within Europe, specifically in Switzerland and the European Economic Area (EEA). The European Commission has recognized Switzerland as providing an adequate level of data protection, ensuring your information is protected to a standard equivalent to that of the EU. Any third parties we share your data with, as described in section 10, are also required to process it within this region. We are committed to working only with service providers who uphold high standards of data security.

12. We store personal information on secure servers that are managed by us and our service providers. We also separated the location of EU user database in a secured server from non-EU database server. We use Microsoft Azure cloud based secured server located in Sweden.

**How you can access your personal information**

13. You can access some of the personal information that we collect about you by logging in to your account. You also have the right to make a request to access other personal information we hold about you and to request corrections of any errors in that data. You can also close the account you have with us for any of our Sites at any time. To make an access or correction request, contact our Data Protection Officer using the contact details at the end of this policy.

**Marketing Choices regarding your personal information**

14. Where we have your consent to do so (e.g. if you have subscribed to one of our e-mail lists or have indicated that you are interested in receiving offers or information from us), we send you marketing communications by email about products and services that we feel may be of interest to you. You can 'opt-out' of such communications if you would prefer not to receive them in the future by using the "unsubscribe" facility provided in the communication itself.

# Data Processor Agreement

**1. Introduction**

1.1 This agreement regarding processing of personal data (the "Data Processor Agreement" or "DPA") regulates M-BIZ Global AG, Company registration CHE-339.626.146 and its Affiliates who are under common control by M-BIZ Global AG (the "Data Processor") processing of personal data on behalf of the Customer or Advertiser (the "Data Controller") and is attached as appendix A to the <https://support.brandedminigames.com/terms-of-use/terms-of-use> (the "Main Agreement"), in which the parties have agreed the terms for the Data Processor's delivery of services to the Data Controller (the "Main Services"). The term "You" in the Main Agreement is the Customer who publishes their branded games by using Branded Mini-Games Studio or by using Branded Mini-Games Enterprise service provided by M-BIZ Global AG for their marketing campaign towards their audience refers to "Data Controller". "Customer Data" means any personal data that M-BIZ Global AG processes on behalf of Customer or Advertiser as a Data Processor in the course of providing the services as described in the Main Agreement and in the DPA.

1.2 This DPA applies where and only to the extent that M-BIZ Global AG processes Customer Data that originates from the EEA and/or that is otherwise subject to EU Data Protection Law on behalf of Customer as Data Processor in the course of providing Services pursuant to the Main Agreement.

1.3 Any claims against M-BIZ Global AG or its Affiliates under this DPA shall be brought solely against the entity that is a party to the Main Agreement. In no event shall any party limit its liability with respect to any individual's data protection rights under this DPA or otherwise. Customer further agrees that any regulatory penalties incurred in relation to the Customer Data that arise as a result of, or in connection with, Customer's failure to comply with its obligations under this DPA or any applicable Data Protection Laws shall count toward and reduce M-BIZ Global AG's liability under the Agreement as if it were liability to the Customer under the Agreement.

1.4 This DPA shall be governed by and construed in accordance with governing law and jurisdiction provision in the Main Agreement, unless required otherwise by applicable Data Protection Laws.

**2. Legislation**

2.1 This Data Processor Agreement is governed by the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation or "GDPR").

**3. Processing of personal data**

3.1 Role of the Parties. As between M-BIZ Global AG and Customer, Customer is the Data Controller of Customer Data, and M-BIZ Global AG shall process Customer Data only as a Data Processor acting on behalf of Customer.

3.2 Customer Processing of Customer Data. Customer agrees that (i) it shall comply with its obligations as a Data Controller under Data Protection Laws in respect of its processing of Customer Data and any processing instructions it issues to M-BIZ Global AG; and (ii) it has provided notice and obtained (or shall obtain) all consents and rights necessary under Data Protection Laws for M-BIZ Global AG to process Customer Data and provide the Services pursuant to the Main Agreement and this DPA.

3.3 M-BIZ Global AG processing of Customer Data. M-BIZ Global AG shall process Customer Data only for the purposes described in this DPA and only in accordance with Customer's documented lawful instructions. The parties agree that this DPA and the Agreement set out the Customer's complete and final instructions to M-BIZ Global AG in relation to the processing of Customer Data and processing outside the scope of these instructions (if any) shall require prior written agreement between Customer and M-BIZ Global AG.

3.4 Details of Data Processing

* Subject matter: The subject matter of the data processing under this DPA is the Customer Data.
* Duration: As between M-BIZ Global AG and Customer, the duration of the data processing under this DPA is until the termination of the Agreement in accordance with its terms.
* Purpose: The purpose of the data processing under this DPA is the provision of the Services to the Customer and the performance of M-BIZ Global AG's obligations under the Agreement (including this DPA) or as otherwise agreed by the parties.
* Nature of the processing: M-BIZ Global AG provides an HTML5 based game editor, users sign up/sign in automation platform, leaderboard tool and other related services.
* Categories of data subjects: Any individual accessing and/or using the Services through the Customer's account ("Users"); and any individual.
* Types of Customer Data: (i) Customer and Users: identification and contact data (name, address, title, contact details, username).

3.5 Notwithstanding anything to the contrary in the Main Agreement (including this DPA), Customer acknowledges that M-BIZ Global AG shall have a right to use and disclose data relating to the operation, support and/or use of the Services for its legitimate business purposes, such as billing, account management, technical support, product development and sales and marketing. To the extent any such data is considered Personal Data under Data Protection Laws, M-BIZ Global AG is the Data Controller of such data and accordingly shall process such data in accordance with the M-BIZ Global AG Privacy Policy and Data Protection Laws.

3.6 "Personal data" include "any information relating to an identified or identifiable natural person" as defined in GDPR, article 4 (1) (1) (the "Personal Data"). The categories and types of Personal Data processed by the Data Processor on behalf of the Data Controller are listed in sub-appendix A. The Data Processor only performs processing activities that are necessary and relevant to perform the Main Services. The parties shall update sub-appendix A whenever changes occur that necessitates an update.

3.7 The Data Processor processes personal data about the Data Controller in connection with the Data Processor's sale, marketing and product development. These personal data are not comprised by this Data Processor Agreement, because the Data Processor is data controller for said personal data, and reference is made to the Data Processor's data protection and privacy policy available at the Data Processor's website.

**4. Instruction**

4.1 The Data Processor may only act and process the Personal Data in accordance with the documented instruction from the Data Controller (the "Instruction"). The Instruction at the time of entering into this Data Processor Agreement is that the Data Processor may only process the Personal Data with the purpose of delivering the Main Services as described in the Main Agreement.

4.2 The Data Controller guarantees that the Personal Data transferred to the Data Processor is processed by the Data Controller in accordance with the Applicable Law, including the legislative requirements re lawfulness of processing.

4.3 The Data Processor shall give notice without undue delay if the Data Processor considers the at the time being Instruction to be in conflict with the Applicable Law.

**5. The Data Processor's obligations**

5.1 Confidentiality

* 5.1.1 The Data Processor shall treat all the Personal Data as strictly confidential information. The Personal Data may not be copied, transferred or otherwise processed in conflict with the Instruction, unless the Data Controller in writing has agreed hereto.
* 5.1.2 The Data Processor's employees shall be subject to an obligation of confidentiality that ensures that the employees shall treat all the Personal Data under this Data Processor Agreement with strict confidentiality.

5.2 Security

* 5.2.1 The Data Processor shall implement the appropriate technical and organizational measures as set out in this Agreement and in the Applicable Law, including in accordance with GDPR, article 32.

5.3 The Data Processor shall ensure that access to the Personal Data is restricted to only the employees or the employees of the affiliates (sub-data processor) to whom it is necessary and relevant to process the Personal Data in order for the Data Processor to perform its obligations under the Main Agreement and this Data Processor Agreement.

5.4 The Data Processor shall also ensure that the Data Processor's employees working processing the Personal Data only processes the Personal Data in accordance with the Instruction.

* 5.4.1 The Data Processor shall provide documentation for the Data Processor's security measures if requested by the Data Controller in writing.

5.5 Data protection impact assessments and prior consultation

* 5.5.1 If the Data Processor's assistance is necessary and relevant, the Data Processor shall assist the Data Controller in preparing data protection impact assessments in accordance with GDPR, article 35, along with any prior consultation in accordance with GDPR, article 36.

5.6 Rights of the data subjects

* 5.6.1 If the Data Controller receives a request from a data subject for the exercise of the data subject's rights under the Applicable Law and the correct and legitimate reply to such a request necessitates the Data Processor's assistance, the Data Processor shall assist the Data Controller by providing the necessary information and documentation. The Data Processor shall be given reasonable time to assist the Data Controller with such requests in accordance with the Applicable Law.
* 5.6.2 If the Data Processor receives a request from a data subject for the exercise of the data subject's rights under the Applicable Law and such request is related to the Personal Data of the Data Controller, the Data Processor must immediately forward the request to the Data Controller and must refrain from responding to the person directly.

5.7 Personal Data Breaches

* 5.7.1 The Data Processor shall give immediate notice to the Data Controller if a breach of the data security occurs, that can lead to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of or access to, personal data transmitted, stored or otherwise processed re the Personal Data processed on behalf of the Data Controller (a "Personal Data Breach").
* 5.7.2 The Data Processor shall have and maintain a register of all Personal Data Breaches. The register shall at a minimum include the following: (i) A description of the nature of the Personal Data Breach, including, if possible, the categories and the approximate number of affected Data Subjects and the categories and the approximate number of affected registrations of personal data. (ii) A description of the likely as well as actually occurred consequences of the Personal Data Breach. (iii) A description of the measures that the Data Processor has taken or proposes to take to address the Personal Data Breach, including, where appropriate, measures taken to mitigate its adverse effects.
* 5.7.3 The register of Personal Data Breaches shall be provided to the Data Controller in copy if so requested in writing by the Data Controller or the relevant Data Protection Agency.

5.8 Documentation of compliance

* 5.8.1 The Data Processor shall after the Data Controller's written request hereof provide documentation substantiating that: (i) the Data Processor complies with its obligations under this Data Processor Agreement and the Instruction; and the Data Processor complies with the Applicable Law in respect of the processing of the Data Controller's Personal Data.
* 5.8.2 The Data Processor's documentation of compliance shall be provided within reasonable time.
* 5.8.3 The Data Processor shall make available to the controller all information necessary to demonstrate compliance with its obligations and allow and cooperate fully with audits, including inspections, conducted by the controller and another person authorised to this end by the controller.

5.9 Location of the Personal Data

* 5.9.1 The Personal Data is only processed by the Data Processor or by approved Sub-Data Processors premise. Personal Data of EU users is exclusively stored on Microsoft Azure cloud servers located in Sweden.
* 5.9.2 Any transfer of the Personal Data to any non-approved third countries or international organizations in the future shall only be done to the extent such transfer is permitted and done in accordance with applicable law.

**6. Sub-Processors**

6.1 Authorized Sub-processors. Customer agrees that M-BIZ Global AG may engage Sub-processors to process Customer Data on Customer's behalf. The Sub-processors currently engaged by M-BIZ Global AG and authorized by Customer are listed in the Sub-appendix B. Upon Customer confirmation on paid pricing for additional analytics and integration service, M-BIZ Global AG may engage with the following processors.

* Google Analytics
* Mixpanel Analytics
* MailChimp Integration

6.2 Sub-processor Obligations. M-BIZ Global AG shall: (i) enter into a written agreement with the Subprocessor imposing data protection terms that require the Sub-processor to protect the Customer Data to the standard required by Data Protection Laws; and (ii) remain responsible for its compliance with the obligations of this DPA and for any acts or omissions of the Sub-processor that cause M-BIZ Global AG to breach any of its obligations under this DPA.

6.3 The Data Processor is given general authorization to engage third-parties (who are nor any affiliates of the nor contractor) to process the Personal Data ("Sub-Processors") without obtaining any further written, specific authorization from the Data Controller, provided that the Data Processor notifies the Data Controller in writing about the identity of a potential Sub-Processor (and its processors, if any) before any agreements are made with the relevant Sub-Processors and before the relevant Sub-Processor processes any of the Personal Data. If the Data Controller wish to object to the relevant Sub-Processor, the Data Controller shall give notice hereof in writing within seven (7) calendar days from receiving the notification from the Data Processor. Absence of any objections from the Data Controller shall be deemed a consent to the relevant Sub-Processor.

6.4 The Data Processor shall conclude a written sub-processor agreement with any Sub-Processors. Such an agreement shall at minimum provide the same data protection obligations as the ones applicable to the Data Processor, including the obligations under this Data Processor Agreement. The Data Processor shall on an ongoing basis monitor and control its Sub-Processors' compliance with the Applicable Law. Documentation of such monitoring and control shall be provided to the Data Controller if so requested in writing.

6.5 The Data Processor is accountable to the Data Controller for any Sub-Processor in the same way as for its own actions and omissions.

6.6 The Data Processor is at the time of entering into this Data Processor Agreement using the Sub-Processors listed in sub-appendix B. If the Data Processor initiates sub-processing with a new Sub-Processor, such new Sub-Processor shall be added to the list in sub-appendix B under paragraph 2.

**7. Breach and liability**

7.1 The Main Agreement's regulation of breach of contract and the consequences hereof shall apply equally to this Data Processor Agreement as if this Data Processor Agreement is an integrated part hereof.

7.2 Each party's cumulated liability under this Data Processor Agreement is limited to the payments made under the Main Agreement in the 12 months before the occurrence of the circumstances leading to a breach of contract. If the Data Processor Agreement has not been in force for 12 months before the occurrence of the circumstances leading to a breach of contract, the limited liability amount shall be calculated proportionately based on the actual performed payments.

7.3 The limitation of liability does not apply to the following:

* (i) Losses as a consequence of the other party's gross negligence or willful misconduct.
* (ii) A party's expenses and resources used to perform the other party's obligations, including payment obligations, towards a relevant data protection agency or any other authority.

**8. Duration**

8.1 The Data processor Agreement shall remain in force until the Main Agreement is terminated.

**9. Termination**

9.1 The Data Processor's authorization to process Personal Data on behalf of the Data Controller shall be annulled at the termination of this Data Processor Agreement.

9.2 The Data Processor shall continue to process the Personal Data for up to three months after the termination of the Data Processor Agreement to the extent it is necessary and required under the Applicable Law. In the same period, the Data Processor is entitled to include the Personal Data in the Data Processor's backup. The Data Processor's processing of the Data Controller's Personal Data in the three months after the termination of this Data Processor Agreement shall be considered as being in accordance with the Instruction.

9.3 At the Data Controllers choosing, the Data Processor and its Sub-Processors shall return the Personal Data processed under this Data Processor Agreement to the Data Controller, provided that the Data Controller is not already in possession of the Personal Data. The Data Processor is hereafter obliged to delete all the Personal Data and provide documentation for such deletion to the Data Controller.

#### Sub-appendix A

**1. Personal Data**

1.1 The Data Processor processes the following types of Personal Data in connection with its delivery of the Main Services:

* (i) Ordinary contact information on relevant employees from the Data Controller.
* (ii) Users of the Main Services: names, telephone numbers, e-mails and user type.

When launching your marketing campaign with Studio (Branded Mini-Games DIY Studio), our tools include game customization, sign-up/sign-in tools, social sharing integration, leaderboards, analytics integration, and other sub-processor integrations such as Mailchimp. You may want to award prizes to top-ranked individuals on a leaderboard or randomly select winners. Even the simple use of a leaderboard requires users to sign up with their personal information. Thus, you are required to obtain consent from users for the personal information they provide for such events. If your campaign targets EU/EEA individuals, please choose the GDPR-friendly form.

If your campaign targets non-EU individuals, please choose the standard form.

Branded Mini-Games provides a GDPR-friendly form to help you create your campaign easily. However, as a Data Controller, you are ultimately responsible for complying with this law.
