Article 1 Purpose
These terms and conditions outline the terms of use, procedures, and other necessary matters regarding the use of the Coupon Town (C-Town) service and related supplementary services (collectively referred to as the “Service”) operated by Emoji Games GmbH (hereinafter referred to as the “Company” or “Emoji Games”).
Article 2 Definitions of Terms
The terms used in these terms and conditions are defined as follows:
1. “C-Town” refers to the online service that allows corporate and brand advertisers or agencies to use the Studio of Branded Mini-Games, a white-label customised solution service (SaaS) provided by the Company, to offer Play and Earn services to general consumers (game players). It includes branded advertisements in HTML5 Branded Mini-Games, allows players to save points through gameplay, and exchange accumulated points for coupons. The service available to general members includes the following:
• Game Service: Mini-games for web browsers that members can play for free to promote a brand. Members can also earn non-cash reward points provided by the brand in certain cases.
• Play and Earn: A loyalty reward service allowing players to exchange game points earned through mini-games for coupons provided by the brand.
2. “Member” refers to an individual user who accesses the Company’s services, agrees to the terms and conditions of the Company, and uses the services provided by the Company. Members may also be referred to as “Players.”
3. “Brand” refers to advertisers that provide mini-game services and Play and Earn opportunities through the Company’s Branded Mini-Games Studio, allowing players to exchange game and shopping points for coupons.
4. “Game Points and Shopping Points” refer to non-cash reward points that can be earned for free through branded mini-games provided by advertisers. Game points (Game Points) and shopping points are required to exchange for free coupons provided by brands. Game points earned through branded mini-games can be converted to shopping points. If not converted within a specified period, game points may be automatically deleted, with the time frame being set by the brand through the Studio. Shopping points can be exchanged for coupons depending on the advertiser’s policy.
Article 3 Membership Registration
Anyone who wishes to become a member must fill in the required information in the registration form provided by the Company or via their selected SNS account and apply for membership by clicking the “Agree,” “Confirm,” or similar buttons. Applicants must be at least 14 years old to become a member, as individuals under the age of 14 are not eligible to register.
Article 4 Obligations of Members
Members are required to understand and comply with these terms, the Company’s announcements, and website usage guidelines. Members must not engage in the following activities:
1. Providing false information during service application or modification.
2. Using another person’s information.
3. Altering information posted by the Company or interfering with the service.
4. Collecting, storing, posting, or disseminating other members’ personal or account information without authorisation.
5. Copying, disassembling, reverse engineering, or otherwise modifying the service.
6. Using hacking or automated access programs to overload the Company’s servers or disrupt its services.
7. Lending, transferring, or granting account access rights to a third party.
8. Transmitting or posting prohibited information (e.g., computer programs).
9. Engaging in gambling, sharing obscene content, or participating in other inappropriate activities.
10. Spamming the bulletin board with repetitive or meaningless posts.
11. Using the service for commercial, political, or electoral purposes without Company approval.
12. Copying, distributing, or exploiting service-related information for commercial purposes.
13. Deceiving others for personal gain or causing harm to others through service use.
14. Infringing upon the copyrights or intellectual property rights of the Company or third parties.
15. Damaging the Company’s reputation or disrupting its operations.
16. Any other illegal or improper activities.
Members must manage their ID, password, and payment information responsibly. The Company shall not be held liable for any issues arising from a member’s negligence in managing their account information.
Article 5 Obligations of the Company
The Company is committed to providing continuous and stable goods or services in accordance with these terms and applicable laws.
The Company shall establish and maintain a security system to protect members’ personal information and must publish and comply with its privacy policy.
Article 6 Provision and Changes to the Service
The Company provides services related to C-Town and may offer additional related services. Updates or changes to the service may be communicated to members via email newsletters.
Article 7 Suspension of Service
The Company may temporarily suspend the service due to maintenance, replacement, breakdown of computer or telecommunication equipment, or network disruptions. It may also discontinue the current service entirely for reasons such as replacing it with a new service or other situations deemed appropriate by the Company.
In the event of such suspension, the Company will endeavour to notify members in advance. However, advance notice may not be possible in cases beyond the Company’s control (e.g., hardware failure or system crashes not caused by the system administrator’s intentional or negligent actions).
Article 8 Membership Termination and Revocation
Members may request membership termination (withdrawal) from the Company at any time, and the Company shall process the termination request.
Upon withdrawal, any unused game points, shopping points, and saved coupons will automatically expire.
The Company may revoke or suspend a member’s membership if the member:
1. Provided false information during registration.
2. Disrupted the service for others or violated electronic commerce regulations.
3. Engaged in prohibited activities outlined in these terms or applicable laws.
Article 9 Restrictions on Service Use
The Company reserves the right to restrict, suspend, or terminate a member’s account if the member’s activity on SNS platforms (e.g., Facebook) includes the following:
1. Slander or defamation of other members or third parties.
2. Dissemination of obscene or vulgar content.
3. Content related to criminal activities.
4. Copyright or intellectual property infringements.
5. Religious or political disputes.
6. Violation of privacy or damage to reputation.
7. Repeated or irrelevant postings.
8. Unauthorised advertisements or promotions.
9. Spamming or disruptive behaviour.
10. Malicious interference with operations.
Article 10 Restrictions on Game and Shopping Points
Members can accumulate game points through branded mini-games and convert them to shopping points based on the conversion ratio set by the brand. Game points may automatically expire based on the brand’s policy, and the expiration date can be checked in the member’s information menu.
Unused game points, shopping points, and stored coupons will expire upon membership termination and cannot be restored.
Article 11 Relationship Between Members and Brands
Members are generally required to agree to the terms of use provided by the brand in addition to the C-Town terms of use. If a brand does not provide its terms of use at the time of sign-up, the Company will not be held responsible for any disputes between the member and the brand. After signing up for C-Town, members need only agree to the terms of use provided by the brand to use other Play and Earn services.
Article 12 Amendment of Terms
The Company may revise these terms and conditions within the bounds of applicable laws, including but not limited to the Swiss Code of Obligations, GDPR, U.S. consumer protection laws, and electronic commerce regulations.
Article 13 Jurisdiction
Disputes arising between the Company and members regarding the use of the service shall be governed by Swiss law. Legal proceedings will be conducted under the jurisdiction of the courts in Canton Zug, Switzerland.
